INFORMATION NOTICE ON THE PROCESSING OF PERSONAL DATA

Zerynth S.p.A. is a Company with registered office in Pisa, Galleria Giovanni Battista Gerace no. 14, 56124, engaged in the management of innovative technologies, with over 15 years of experience.

Preamble

A – Zerynth, owner and proprietor of the Zerynth project and trademark, is active in the sector of design, creation, and sale of solutions in the IoT (Internet of Things) field, mobile software applications, web, stand-alone and embedded applications, electronic, mechatronic, and intelligent devices, as well as analysis and measurement instruments, uniquely identified in its reference market by the trademark “Zerynth”.

B – The website with the domain “https://www.zerynth.com/” (hereinafter, the “Portal”) and all its contents are the property of Zerynth S.p.A.

C – The Portal, access to which has been requested by accessing the URL https://www.zerynth.com/, is compliant with the General Data Protection Regulation (EU Reg. 679/2016, hereinafter “GDPR”) and the Privacy Code (Legislative Decree 30.06.2003 n. 196) as well as the Consumer Code, and allows navigating Users to benefit from its functionalities in compliance with the regulations.

D – Zerynth protects the privacy of its users and the security of the information and data it processes throughout their stay on its web pages and has provided a detailed document illustrating the methods by which its activity complies with Privacy Rules. This document describes, inter alia, which personal data are collected, the purposes and methods of processing for which the personal data are intended, and the security measures adopted for their protection.

E – Zerynth informs that the “Data Controller” (Titolare del trattamento) pursuant to the Privacy Code is Zerynth S.p.A., with registered office in Pisa (56124), Galleria Giovanni Battista Gerace no. 14, in the person of its Legal Representative, Gabriele Montelisciani.

Purposes of processing

The Portal https://www.zerynth.com/ has been created to allow easy and clear use of information relating to:

  • knowing the skills, purposes, activities, and trademarks of Zerynth, including their specific technological characteristics, fields of application, and general use;
  • knowing aspects, methods, and sectors of commercial communication of the trademarks and/or products and services referable to Zerynth;
  • goods and services offered by Zerynth, including through the download of programming guides, information material, Python libraries, as well as through access to the Community Forum and Zerynth Tutorials;
  • remaining in contact with Zerynth to receive information and commercial proposals.

The personal data and all information collected are linked to the access and stay on the Portal “https://www.zerynth.com/” and are configured as follows:

a) Mandatory information which, pursuant to Art. 6 lett. b) and e) of the GDPR, is necessary to use the Service and without which Zerynth will not be able to provide the requested access to the website. This may concern:

  • Information mandatory/necessary for technical reasons to make available and/or facilitate access to the Portal, which will be collected, stored, and used for a short time;
  • Logs recording site access: IP address; date and time of access; access status and HTTP status code; volume of data transferred and content of the request; time zone differences relative to Greenwich (GMT); language settings; browser versions; operating system versions in use; navigation path within the site; any errors;
  • Data related to content entered by the user (e.g., Support requests in the dedicated Helpdesk form, search queries in the Articles section, check marks and/or “meta tag” sharing functions within chosen “heads”, such as to configure Snippets within search engines) published by the user on the Portal;
  • Voice commands: provisions may be made to use voice commands for voice control of activities and services. Such functionalities require access to certain functions of your device in order to improve the interactive experience. Your consent expressed through device commands will allow the collection of information for the specific purposes indicated in the reference section.

Specifically regarding mobile devices:

  • Location: Your explicit consent will allow the collection and use of data related to sensors necessary to access information. This information will allow the recording of the specific location of your mobile device (using, for example, GPS or Bluetooth). In any case, the recording of your IP address is essential to determine, for example, which country you are in, in order to comply with regulations and existing industrial property agreements.
  • Voice: Your explicit consent to microphone access will allow, if provided for, increasing the interactivity of the experience with our Services. You will always have the possibility to disable access to the microphone.

Refusal to communicate data entails the impossibility of completing registration and utilizing Zerynth services. We will collect and encrypt your authentication passwords.

b) Information that may be provided optionally, only subject to your specific and distinct consent (Art. 7 GDPR):

  • For the following commercial information and Marketing purposes: sending via e-mail, post and/or messaging, newsletters, commercial communications and/or advertising material on products or services offered by Zerynth and detection of the degree of satisfaction with the quality of services which presuppose the processing of registration and authentication data: name, surname, username, password, e-mail address, date of birth, gender, address, postal code, and Country. These types of data are provided optionally by the user only by filling out the information request form and/or where subscription to the “newsletter” is requested;
  • Information and statistical data collection tools to measure the correspondence of products to Users’ expectations: Facebook pixel (https://www.facebook.com/business/help/742478679120153).

c) Cookies: The Portal “https://www.zerynth.com/” uses small text files that are stored in the terminal memory via the access browser, such as the language and/or settings preferred by the User, in order to make navigation more pleasant and consistent with the User’s tastes. Zerynth has provided an adequate notice on the use and disabling of Cookies on the Web pages of its portals, available at the address “https://www.zerynth.com/privacy/”.

For sharing purposes: information lacking identifying and profiling elements will be shared with the SHAREHOLDERS (SOCI) and Partners of Zerynth itself, to help commercial partners provide us with utilities, services, and promotional activities, as well as to improve the quality of services and products rendered, and to evaluate commercial and employment collaboration hypotheses (“https://www.linkedin.com/psettings/privacy”) submitted by you and therefore to your exclusive benefit.

In particular, by expressing consent to allow the collection of data for statistical purposes and to improve the interaction between Zerynth and the User and to receive “exclusive offers and promotions” and/or to receive updates regarding initiatives related to Zerynth products for any applications or for job offers and positions, the user consents to and authorizes the collection, use, sharing, and other processing of their information, including any advertising purposes.

Data may also be communicated and shared with:

  • Personnel and consultants of Zerynth and SHAREHOLDER Companies and/or companies Affiliated with Zerynth;
  • State Financial Administration and Public Administration;
  • Judicial authorities and police forces, should Zerynth receive a formal request from the judicial authority in relation to inquiries, investigations, and assessments regarding the alleged violation of rules and rights of third parties;
  • Subjects having the purpose of study and publication of de-identified or aggregated information relating to the use of the Service;
  • Third-party providers of generative artificial intelligence services for the purposes of the Services purchased.

Exclusion from processing

In the event of access from a mobile support, data relating to the functionalities of your Hardware support such as photos and camera will not be collected or processed; nor will: position; specific geo-localization (data from the “touch screen”; information from accelerometer and gyroscope sensors of the device, relating to the specific position of your mobile device, nor is there any possibility of interfacing with proximity applications i.e.: iBeacon); voice; contacts; data relating to access and preferences expressed during the stay.

The Portal is designed and intended for use by adults and not to be used by children under the age of 18. The use of identity credentials not corresponding to the user intending to register constitutes illegitimate impersonation (sostituzione di persona) and as such constitutes a crime against public faith.

Data retention

The only data that will be collected, as referred to in point a) above, will be stored on servers dedicated to us located in Germany at Hetzner Online GmbH (https://www.hetzner.com/rechtliches/datenschutz), appointed for this purpose, where they will be processed to allow the functionalities described in this notice. Data will not be transferred outside European borders without express and motivated authorization. Zerynth guarantees the maximum confidentiality of personal data by applying the most suitable technologies, in compliance with Italian and European standards regarding minimum security measures to avoid unauthorized access to its databases, potential loss and/or accidental destruction of data.

Access to personal data will also be permitted to the personnel of all operational Offices of the Data Controller and in all other places of processing where the Interested Parties are located: in particular to subjects appointed as “Data Processor” (Responsabile del Trattamento), pursuant to Art. 4 GDPR, as well as to personnel assigned to the security of telematics networks and generally subjects who have been designated as “Authorized Persons” (Incaricati) for Processing pursuant to Art. 2-quaterdecies of the Privacy Code to offer support to users in relation to services offered by Zerynth, to respond to requests from the Judicial Authority, to verify non-compliant behaviors, and for any other need.

Zerynth guarantees a daily backup of the data it processes; backup data are saved in the EU, on AWS servers in Ireland and Hetzner servers in Germany and Finland.

Exercise of rights by the data subject

Zerynth ensures data subjects the possibility to exercise the rights recognized by Art. 15 of EU Regulation 679/2016 (GDPR) and specifically to:

  1. Obtain information regarding the existence or non-existence of personal data concerning you and their communication in intelligible form (Right of Access – Art. 15 GDPR).
  2. Obtain the indication of: a) the origin of the personal data collected or processed; b) the purposes and methods of processing; c) the categories of personal data subject to processing; d) the retention period of personal data if identified, otherwise the criteria used to determine said period; h) [sic] the logic applied in case of processing carried out with the aid of electronic instruments; d) [sic] the identification details of the Controller, the Processors, and the designated representative pursuant to Art. 3, paragraph 1, EU Regulation 679/2016; e) the subjects or categories of subjects to whom personal data may be communicated or who may become aware of them in their capacity as designated representative in the territory of the State, processors, or authorized persons.
  3. Request: a) the updating, rectification, and, hypothetically, the integration of data; b) the cancellation, transformation into anonymous form, or blocking of data processed in violation of the law, including those for which retention is not necessary in relation to the purposes for which the data were collected or subsequently processed; c) the attestation that the operations referred to in letters a) and b) have been brought to the attention, also as regards their content, of those to whom the data have been communicated or disseminated, except in the case where such fulfillment proves impossible or involves a use of means manifestly disproportionate to the protected right.
  4. Object, in whole or in part, to the processing of personal data concerning you: a) for legitimate reasons, even if pertinent to the purpose of collection; b) for the purpose of sending advertising material or direct selling or for carrying out market research or commercial communication, through the use of automated systems and/or via e-mail and/or through traditional marketing methods via telephone and/or paper mail. Please note that the Right to Object (Art. 21 GDPR) may also be exercised only in part. Therefore, the data subject may decide to receive only communications via traditional methods or only automated communications or neither type of communication.
  5. Exercise the rights referred to in Arts. 16-21 GDPR (Right to rectification, Right to erasure/be forgotten, Right to restriction of processing, Right to data portability, Right to object), as well as the Right to lodge a complaint with the Supervisory Authority (Garante).

The aforementioned rights may be exercised by contacting the Data Controller, Zerynth S.p.A., with registered office in Pisa (56124) Galleria Giovanni Battista Gerace no. 14, in the person of its legal representative pro-tempore, Eng. Gabriele Montelisciani, by means of registered letter with return receipt, or alternatively by contacting us at the e-mail address privacy@zerynth.com.

The Controller has the burden of verifying, pursuant to Art. 12 par. 6 GDPR, the identity of the Data Subject intending to exercise the aforementioned rights. The updated list of Data Processors and Authorized Persons is kept at the registered office of the Data Controller. Zerynth undertakes to periodically review and update, where necessary, the technical and organizational measures relating to the security of data processing.
